Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Allay platform ("Platform"), operated by Bereev Sdn Bhd ("Allay", "we", "us" or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About Allay

Allay is a digital bereavement support platform developed and operated by Bereev Sdn Bhd, a company incorporated in Malaysia. We help individuals and families navigate administrative and emotional challenges following the loss of a loved one. The Platform provides tools, resources and guidance. It does not provide legal, financial, medical or professional advice of any kind.

2. Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you confirm that you are 18 or older. We reserve the right to suspend or terminate accounts where we reasonably believe this requirement has not been met.

3. Your Account

By registering for an account, you agree to the following:

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2. Accuracy

You must provide accurate and complete information when creating your account and keep it updated.

3. Unauthorised Access

You must notify us immediately at allay.appmy@gmail.com if you suspect any unauthorised access to your account.

4. Non-Transferable

Your account is personal and may not be shared or transferred.

4. How You May Use the Platform

You may use the Platform only for lawful personal purposes in connection with bereavement support and estate-related matters. You agree not to:

Unlawful Use: Use the Platform for any unlawful purpose or in violation of Malaysian law.
False Content: Upload any content that is false, misleading, fraudulent or infringes any third-party rights.
Unauthorised Access: Attempt to gain unauthorised access to any part of the Platform or its underlying systems.
Reverse Engineering: Reverse-engineer, copy, modify or distribute any part of the Platform without our prior written consent.
Interference: Use the Platform in a way that damages, disables or impairs its functionality.

We reserve the right to suspend or terminate your access immediately if you breach any of the above.

5. Content You Upload

You retain ownership of all documents and content you upload to the Platform. By uploading content, you grant Allay a limited, non-exclusive licence to store and process that content solely for the purpose of providing the services to you.

You are solely responsible for ensuring that any content you upload is accurate, lawful and does not infringe any third-party rights. Allay does not verify the authenticity of documents uploaded to the Platform.

6. Payments

Where you access the Platform through a partner organisation, fees are covered by that partner and no payment is required from you directly.

Where you subscribe to the Platform directly, the following applies:

All fees and billing cycles will be clearly displayed at the point of purchase.
All payments are processed securely through our designated payment provider.
Fees are stated exclusive of applicable taxes, including Sales and Service Tax (SST), which shall be borne by you where applicable.
Subscriptions are non-refundable unless otherwise required by Malaysian consumer protection law.
Access may be suspended if payment is not received by the due date.

7. Platform Availability

We aim to keep the Platform accessible at all times but do not guarantee uninterrupted availability. The Platform is provided on an 'as is' basis. We may carry out maintenance, updates or improvements from time to time, during which access may be temporarily unavailable. We will endeavour to provide advance notice of planned downtime where reasonably practicable.

The Platform provides information and guidance only. Nothing on the Platform constitutes legal, financial, medical, psychological or any other form of professional advice. You should always seek independent professional advice for matters specific to your circumstances. Allay accepts no responsibility for any decisions made or actions taken in reliance on information provided through the Platform.

9. Intellectual Property

All intellectual property rights in and to the Platform, including its software, design, content, trademarks and underlying technology, are owned by Allay. Nothing in these Terms grants you any right, title or interest in Allay's intellectual property.

You may use the Platform solely for the personal purposes described in these Terms. Any other use requires our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by Malaysian law, Allay shall not be liable to you for any direct, indirect, incidental, special, consequential or punitive damages arising from your use of or inability to use the Platform, regardless of the cause or theory of liability.

Nothing in these Terms excludes liability for fraud or for death or personal injury caused by our negligence, or any other liability that cannot be lawfully excluded under Malaysian law.

11. Third-Party Links and Services

The Platform may contain links to third-party websites or services. These links are provided for your convenience only. Allay does not endorse and has no control over the content, privacy practices or terms of any third-party website or service. Your use of any third-party service is at your own risk.

12. Termination

You may close your account at any time by contacting us at allay.appmy@gmail.com. Upon closure, your access to the Platform will cease and your personal data will be handled in accordance with our Privacy Policy.

We may suspend or terminate your access without notice if you breach these Terms, or with reasonable notice if we discontinue the Platform.

13. Changes to These Terms

We may update these Terms at any time. We will notify you of changes by posting the updated Terms on the Platform and updating the 'Last Updated' date above. Your continued use of the Platform after any update constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

14. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Malaysian courts.
